Streamer Terms of Service

1.1 Nature of Relationship

You are an independent content creator who uses Sync Sport's synchronization technology to enhance your broadcasts on third-party platforms (Twitch, YouTube, etc.). This creates a partnership relationship where you represent our brand while streaming.

1.2 Platform Usage

You use Sync Sport to synchronize your commentary with live TV broadcasts while streaming on your own platforms. You do not broadcast through Sync Sport itself.

1.3 Acceptance of Terms

By participating in our streamer program, you agree to both these Streamer Terms and our standard Terms of Service. Where conflicts exist, these Streamer Terms take precedence for streamer-specific matters.

2.1 Professional Representation

When using Sync Sport during your broadcasts, you agree to:

• Present Sync Sport in a professional and positive manner
• Provide accurate information about the platform's functionality
• Maintain appropriate content standards that reflect well on our brand
• Avoid making false or misleading claims about our services

2.2 Content Guidelines

While streaming with Sync Sport integration:

• Comply with all applicable laws and third-party platform rules
• Avoid content that is illegal, harmful, or offensive
• Respect copyright and intellectual property rights
• Do not stream inappropriate content while visibly using Sync Sport

2.3 Technical Usage

You agree to:

• Use Sync Sport only for its intended synchronization purposes
• Not attempt to reverse-engineer or modify our technology
• Report technical issues and provide feedback constructively
• Keep your Sync Sport account and software updated

3.1 Referral Commissions

If you participate in our affiliate program:

• You may earn commissions from valid referrals using your unique codes
• Commission rates and payment terms are provided separately in your affiliate agreement
• Referrals must result in genuine paid subscriptions to qualify for commissions
• Self-referrals, fake accounts, or fraudulent activities void all commissions

3.2 Promotional Guidelines

When promoting Sync Sport:

• Clearly disclose your affiliate relationship as required by law
• Use only approved promotional materials and messaging
• Do not spam or engage in aggressive marketing tactics
• Avoid misleading pricing claims or false urgency tactics

3.3 Brand Usage Rights

We grant you limited rights to use Sync Sport branding in connection with approved promotional activities. You may not modify our logos, create derivative works, or use our branding for purposes other than promotion of our services.

4.1 Platform Terms Compliance

You must comply with the terms of service of your broadcasting platforms:

• Twitch Terms of Service and Community Guidelines
• YouTube Terms of Service and Community Guidelines
• Any other platforms where you broadcast while using Sync Sport
• Platform-specific monetization and advertising policies

4.2 Content Responsibility

You remain solely responsible for all content you create and broadcast. Sync Sport is not responsible for any violations of third-party platform rules or policies that occur during your broadcasts.

4.3 Account Standing

If your account on any broadcasting platform is suspended, banned, or restricted due to violations while using Sync Sport, we reserve the right to review your participation in our streamer program.

5.1 Additional Data Collection

As a streamer, we may collect additional information:

• Streaming platform usernames and channel information
• Performance metrics and usage analytics
• Payment information for affiliate commissions
• Tax information as required by law

5.2 Performance Analytics

We may track how Sync Sport is used during your broadcasts for improvement purposes and to calculate affiliate commissions. This data is used in accordance with our Privacy Policy.

5.3 Public Information

By participating as a featured streamer, you consent to us showcasing your channel and content (with proper attribution) in our marketing materials, subject to your approval.

6.1 Commission Payments

For affiliate commissions:

• Payments are made monthly for earnings above the minimum threshold
• All payments are subject to applicable taxes and withholdings
• You are responsible for providing accurate payment and tax information
• Commission rates and payment schedules are detailed in your affiliate agreement

6.2 Tax Responsibilities

You are responsible for all tax obligations related to commissions earned. We will provide necessary tax documentation as required by law.

6.3 Payment Disputes

Any disputes regarding commission calculations must be raised within 60 days of the payment period in question.

7.1 Your Content Ownership

You retain ownership of all content you create. However, by using Sync Sport during broadcasts, you grant us permission to reference, link to, or feature your content for promotional purposes with proper attribution.

7.2 Sync Sport IP

All Sync Sport technology, branding, and intellectual property remain our exclusive property. Your use of our platform does not grant any ownership rights.

7.3 Third-Party Content

You remain responsible for ensuring you have appropriate rights to any third-party content (music, images, etc.) used in your broadcasts, regardless of Sync Sport usage.

8.1 Program Termination

We may terminate your participation in the streamer program for:

• Violation of these Streamer Terms or our general Terms of Service
• Inappropriate representation of our brand
• Fraudulent activity or commission manipulation
• Extended inactivity or non-compliance with program requirements

8.2 Your Right to Terminate

You may leave the streamer program at any time by providing 30 days written notice. Outstanding commissions will be paid according to our standard payment schedule.

8.3 Effect of Termination

Upon termination, your promotional rights end immediately, but you may continue using Sync Sport as a regular subscriber under our standard Terms of Service.

9.1 Platform Liability

Our liability remains limited as outlined in our general Terms of Service. We are not responsible for any losses related to third-party platform actions, content violations, or broadcast interruptions.

9.2 Streamer Indemnification

You agree to indemnify Sync Sport from any claims arising from your broadcasts, content, or violations of third-party platform terms while using our service.

9.3 Third-Party Platforms

We are not responsible for changes to third-party platform policies, features, or availability that may affect your ability to use Sync Sport while broadcasting.

10.1 Changes to Streamer Terms

We may update these Streamer Terms with 30 days notice to active streamers. Continued participation constitutes acceptance of changes.

10.2 Governing Law

These terms are governed by the laws of England and Wales, consistent with our general Terms of Service.

10.3 Independent Contractor

Nothing in these terms creates an employment relationship. You remain an independent contractor responsible for your own business operations and tax obligations.
